Policies
SCHEDULING – We schedule clients according to our photographers’ availability on a first-come, first-serve basis.
RESCHEDULING & CANCELLATION – In the event of cancellation, the client is responsible for payment of 50% of the photographer’s fee. In the event of postponement on the part of the client or third-party responsible to the client’s project, less than 72 hours from the scheduled time, an additional 30% of the fee will be assessed to the total.
WEATHER – We reserve the right to cancel a job in the event of inclement weather and will reschedule at the earliest convenience.
COORDINATION – Please refer to our General Shoot Coordination Worksheet. If Client fails to coordinate these request in a manner that proves disruptive to or delays the Photographer’s duty to perform the work during the scheduled shoot session, resulting in cancellation or postponement of any segment, Client is responsible to pay for the entire scheduled work to be performed and any additional time for which the Photographer needs to return to complete the Work.
Terms
LICENSE AND RIGHTS GRANTED
Unlimited license and rights granted in time and use for website, print collateral, and advertising. Photos are non-transferrable to another individual or company. Any additional party contributing to the creative fee may purchase license and rights granted of all delivered photographs.
INDEPENDENT CONTRACTOR RELATIONSHIP
Photographer agrees to perform the services hereunder solely as an Independent Contractor. Client and Photographer recognize that this Agreement does not create any actual, implied, or apparent agency, partnership, franchise, or relationship of employer and employee between the parties. Photographer is in no way whatsoever authorized to enter into or commit Client to any agreements. Photographer shall not represent itself as the agent or legal representative of Client at any time.
DIGITAL IMAGES
Upon receipt of the images from the photography session(s), Client accepts all responsibility for archiving and protecting the image files. Photographer does not permanently archive image files. Photographer is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read discs provided. It is Client’s responsibility to make sure that digital files are copied to new media as required. Photographer is not responsible for the quality of prints should Client decide to make its own prints. Upon request, Photographer will provide a Photograph Release allowing Client to make limited reproductions of the images for Client’s use only. Client agrees not to duplicate the image files and/or provide them to third parties, other than as specifically licensed herein.
COPYRIGHT
Photographer owns the copyrights to all images from Client’s photography sessions, inclusive of all digital images, along with the prints and storage media of such images (collectively, the “Works”) under the United States Copyright Act (17 U.S.C. §§ 101 et al.). Client hereby waives any claims for ownership, income, editorial control, and use of the images. Client acknowledges that any unauthorized duplication, transmission, or dissemination of the Works constitutes copyright infringement, is unlawful, and may be subject to legal proceedings.
